OVERVIEW
Welcome to Momo Pets ("we", "us", "our"). Momopets Ltd, a company registered in England and Wales (company number 17241854), operates the store at momopets.co.uk and the related online services, including all related information, content, features, tools, products and services (the "Services"). Momo Pets is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service ("Terms"), together with any policies referenced below, describe your rights and responsibilities when you use the Services.
Please read these Terms carefully. They include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy (https://momopets.co.uk/policies/privacy-policy). If you do not agree, please do not use our Services.
These Terms do not affect your statutory rights as a consumer under UK law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
SECTION 1 — ACCESS AND ACCOUNT
By agreeing to these Terms, you confirm that you are at least 18 years old, or the age of legal majority in your country of residence, and that you consent to any minor dependents using the Services on devices you own or manage.
To use the Services — including browsing our store or purchasing products — you may be asked to provide certain information such as your email address, billing, payment, and shipping details. You confirm that all information you provide is accurate, current and complete, and that you have the right to share it with us.
You are responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell, assign, or license your account to anyone else.
SECTION 2 — OUR PRODUCTS
We make every effort to represent our products and services accurately on our store. However, colours and product appearance may differ from how they appear on your screen due to your device's display settings.
We do not warrant that the appearance or quality of products will exactly match how they appear online. All product descriptions are subject to change at any time at our sole discretion. We reserve the right to discontinue any product, or to limit quantities offered to any person, location, or region, on a case-by-case basis.
SECTION 3 — ORDERS
When you place an order, you are making an offer to purchase. Momo Pets reserves the right to accept or decline any order at our discretion. Your order is not accepted until we confirm acceptance — typically by sending an order confirmation email. We must receive and process your payment before your order is accepted.
Please review your order carefully before submitting, as we may not be able to accommodate cancellation requests after an order is accepted. If we cancel or change an order, we will contact you using the email or phone number provided at checkout.
Your right to return or exchange purchases is governed by our Refund Policy (https://momopets.co.uk/policies/refund-policy), and your statutory rights under UK consumer law remain unaffected.
You confirm that your purchases are for your own personal or household use and not for commercial resale or export.
SECTION 4 — PRICES AND BILLING
Prices, discounts and promotions are subject to change without notice. The price charged will be the price displayed when you place your order and will be confirmed in your order confirmation email. Unless stated otherwise, prices include UK VAT where applicable but exclude shipping, handling, customs, or import charges (where relevant).
Prices in our store may differ from prices offered through any third-party platform. From time to time we may run promotions governed by separate terms; if a conflict arises, the promotion terms will govern.
You agree to provide current, complete, and accurate payment and account information for all purchases, and to update your details promptly if anything changes.
You confirm that (i) the payment information you provide is correct and current, (ii) you are authorised to use the payment method, (iii) the charges will be honoured by your bank or card issuer, and (iv) you will pay all charges at the prices displayed, including shipping, handling, and any applicable taxes.
SECTION 5 — SHIPPING AND DELIVERY
We are not liable for shipping or delivery delays. All delivery times shown are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs, or events outside our reasonable control.
Once we hand the package to the carrier, risk of loss passes to you. However, your statutory rights under the Consumer Rights Act 2015 (including the right to receive goods in satisfactory condition) remain unaffected.
SECTION 6 — INTELLECTUAL PROPERTY
Our Services — including all trademarks, brands, text, images, graphics, product reviews, video, audio, and the selection and arrangement thereof — are owned by Momopets Ltd, its affiliates, or its licensors and are protected by UK and international copyright, trademark, and other intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Services without our prior written consent.
Momo Pets's name, logo, product and service names, designs, and slogans are trademarks of Momopets Ltd. You must not use these without our prior written permission. Shopify's name, logo, and trademarks belong to Shopify. All other trademarks belong to their respective owners.
SECTION 7 — OPTIONAL THIRD-PARTY TOOLS
You may be given access to third-party tools as part of the Services. We do not monitor or control these tools, and they are provided "as is" and "as available" without warranties or endorsement of any kind. We are not liable for your use of any optional third-party tools.
You should review and accept the relevant third-party terms before using any such tools. New features or tools we add to the Services in the future will also be subject to these Terms.
SECTION 8 — THIRD-PARTY LINKS
The Services may contain links to third-party websites or embedded third-party functionality. We are not responsible for examining or evaluating the content or accuracy of those sites or materials. If you choose to access them, you do so at your own risk.
We are not liable for any harm or loss arising from your access to third-party websites or your purchase or use of third-party products or services. Please review the relevant third party's policies before transacting. Any complaints or claims about third-party products or services should be directed to the third party.
SECTION 9 — RELATIONSHIP WITH SHOPIFY
Momo Pets is powered by Shopify. Any sales and purchases you make in our store are made directly with Momopets Ltd. Shopify is not responsible for any aspect of any sale between you and us, including any injury, damage, or loss resulting from purchased products. You release Shopify and its affiliates from all claims, damages, and liabilities arising from your purchases and transactions with us.
SECTION 10 — PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy (https://momopets.co.uk/policies/privacy-policy). Certain personal information may also be subject to Shopify's Privacy Policy (https://www.shopify.com/legal/privacy).
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services. Information you submit may be transmitted to and shared with Shopify and third parties located in countries other than your own, in order to provide the Services. You also confirm that: (i) you own or have all rights to the Feedback; (ii) you have disclosed any compensation or incentive received in connection with the Feedback; and (iii) your Feedback complies with these Terms.
We have no obligation to keep Feedback confidential, pay for it, or respond to it. We may, but are not obliged to, monitor, edit, or remove Feedback that we consider unlawful, offensive, threatening, defamatory, obscene, or otherwise objectionable. You are solely responsible for any Feedback you submit, and we accept no liability for it.
SECTION 12 — ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information in our Services that contains typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, shipping charges, transit times, or availability. We reserve the right to correct any such errors, change information, or cancel orders if any information is inaccurate — at any time, without prior notice, even after you have submitted your order.
SECTION 13 — PROHIBITED USES
You may access and use the Services for lawful purposes only. You may not use the Services: (a) for any unlawful or malicious purpose; (b) to violate any UK, international, or local law or regulation; (c) to infringe our intellectual property or that of others; (d) to harass, abuse, defame, or harm any person; (e) to transmit false or misleading information; (f) to upload material that breaches these Terms; (g) to send spam, chain letters, junk mail, or unsolicited advertising; (h) to impersonate any person or entity; or (i) to engage in any conduct that restricts others' use of the Services or that may harm Momo Pets, Shopify, or users.
You also agree not to: (a) upload viruses or malicious code; (b) reproduce, copy, sell, or exploit any portion of the Services; (c) collect personal information of others; (d) spam, phish, pharm, or pretext the Services; (e) use any robot, spider, scraper, data-gathering tool, AI agent, or other automated means to access the Services; or (f) bypass any security or authorisation measures we use.
We may suspend, disable, or terminate your account at any time, without notice, if we determine that you have breached these Terms.
SECTION 14 — AGENTS
14.1 This section applies if you use, allow, enable, or deploy any "Agent" to access, use, or interact with the Services. An Agent is any software or service that takes autonomous or semi-autonomous action on your behalf and can run on your device or systems without direct supervision.
14.2 No Agent may access, use, or interact with the Services unless it identifies itself and operates in accordance with section 14.4 at all times. Agents must not access the Services after we request that they refrain from doing so.
14.3 We may limit, including by technical measures, whether and how any Agent accesses or interacts with the Services.
14.4 Agents must: (i) identify themselves in every HTTP/HTTPS request by including "Agent/[agent name]" in the user-agent string; (ii) not conceal or obfuscate Agent activity, including by mimicking human behaviour or bypassing CAPTCHAs; (iii) respond truthfully to any prompt seeking to distinguish a human from a computer; and (iv) not circumvent any measure intended to block or limit Agent access.
SECTION 15 — TERMINATION
We may terminate this agreement or your access to the Services at our sole discretion at any time without notice. You remain liable for all amounts due up to the date of termination.
The following sections survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy Policy, and any others that by their nature should survive.
SECTION 16 — DISCLAIMER OF WARRANTIES
Information on the Services is provided for general information only. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is at your own risk.
Except as expressly stated by Momo Pets, the Services and all products are provided on an "as is" and "as available" basis, without any warranties of any kind, express or implied — to the maximum extent permitted by law. We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free.
Nothing in this section limits any non-excludable rights you have under the Consumer Rights Act 2015 or other UK consumer protection laws.
SECTION 17 — LIMITATION OF LIABILITY
To the fullest extent permitted by law, Momopets Ltd, our directors, officers, employees, affiliates, agents, contractors, service providers, licensors, and those of Shopify and its affiliates, shall not be liable for any injury, loss, claim, or any indirect, incidental, punitive, special, or consequential damages — including lost profits, lost revenue, lost data, or replacement costs — arising from your use of the Services or any products purchased through them, even if we were advised of the possibility of such damages.
Nothing in this section excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded under English law.
SECTION 18 — INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Momopets Ltd, Shopify, and our respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims (including reasonable legal fees) arising out of (1) your breach of these Terms or any document incorporated by reference; (2) your violation of any law or the rights of any third party; or (3) your access to or use of the Services.
We will notify you of any indemnifiable claim. We may control the defence and settlement of any such claim at your expense, with our choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defence of indemnified claims.
SECTION 19 — SEVERABILITY
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will still be enforceable to the fullest extent permitted by law. The unenforceable portion will be severed, and the remainder of the Terms will remain valid and enforceable.
SECTION 20 — WAIVER AND ENTIRE AGREEMENT
Our failure to exercise or enforce any right or provision in these Terms does not waive that right or provision.
These Terms, together with any policies posted by us, form the entire agreement between you and us regarding the Services. They supersede any prior agreements or communications, whether oral or written, including earlier versions of these Terms.
Any ambiguities in interpreting these Terms will not be construed against the drafting party.
SECTION 21 — ASSIGNMENT
You may not transfer or assign these Terms or any of your rights under them without our prior written consent — any such attempt will be void. We may transfer or assign these Terms, and our rights and obligations under them, without consent or notice to you.
SECTION 22 — GOVERNING LAW
These Terms and any separate agreements through which we provide Services are governed by the laws of England and Wales. You and Momopets Ltd agree to submit to the exclusive jurisdiction of the courts of England and Wales, except that consumers resident in Scotland or Northern Ireland may also bring proceedings in their local courts.

The headings in these Terms are for convenience only and do not affect interpretation.

We reserve the right to update, change, or replace any part of these Terms by posting updates on our website. It is your responsibility to check this page periodically.
